EXECUTIVE DECREE N.°12207-J: REGULATIONS OF FEES FOR REGISTRATION OF PLANS IN THE NATIONAL LAND REGISTRY

 

To distinguish between surveys made in parcels located in rural and urban zones, this Decree sets fees for registering topographical plans in the National Land Registry according to the area indicated by the survey. The following fees are valid for plans of urban parcels of up to 1,000 m2 within quadrants. A fee of ¢100.00 for every 1,000 m2 or additional fraction thereof will be charged for lots of 1,000 m2 or more. Examples:

 

Parcel area: 300 m2

RF =¢290

Parcel area: 16,000 m2

RF = ¢370+[(16,000-1,000)x(100/1,000)]= ¢1,870

Parcel area: 16,001 m2

RF = ¢370+[(17,000-1,000)x(100/1,000)] = 197.00 THIS SHOULD BE 1970

Where RF =  registration fee = ¢370 for a 1,000 m2 lot

The fees shown in the table above are valid for plans of urban parcels measuring up to 1,000 m2, located outside of residential and housing development blocks. Sixty colones will be charged for parcels measuring between 1,000 m2 and 10,000 m2, for every 1,000 m2 or additional fraction.

 

Examples:

Parcel area: 3,200.25 m2

RF = ¢300+[(4,000-1,000)x(60/1,000)]= ¢480

Parcel area: 1800.00 m2

RF = ¢300+[(2,000-1,000)x(60/1,000)]= ¢360

 

Where RF =  registration fee = 300.00 for a 1,000 m2 lot

            The fees indicated in the table below are valid for plans of rural parcels smaller than 5 hectares:

Starting at 1,000 m2, the fee goes up by ¢200 for every 1,000 m2 or additional fraction. Example:

 

Parcel area: 30,000.00 m2:

RF = ¢440+[(30,000-1,000)x(20/1,000)]= ¢840 THIS SHOULD BE ¢1020

¢440 fee for a 10,000 m2 lot

           

Since increments are constant in the table, the cost may be calculated based on any value; for instance, the fee to pay for a 3000 m2 lot would be:

 

RF = ¢300+[(30,000-3,000)x(20/1,000)]= ¢840

¢300.00: fee for a 3,000 m2 lot

 

Parcel area: 31,125.50 m2:

RF = ¢300+[(32,000-3,000)x(20/1,000)]= ¢880

¢300.00: fee for a 3,000 m2 lot

 

The fees in the following table are valid for plans of rural parcels larger than 5 hectares. Starting at 100 hectares, ¢20.00 will be charged for every 10,000 m2 or additional fraction. Examples:

 

Parcel area: 730,255.50 m2

RF = ¢1,655.00

 

Parcel area: 1,134,588.20 m2

RF = ¢1,755+[(114-100)x(20)]= ¢2,035

¢1,755.00 = fee for a 100 ha plan

 

Parcel area: 2,344,505.99 m2

RF = ¢1,755+[(235-100)x(20)]= ¢1,755+¢2,700=¢4,455.00

¢1,755.00 = fee for a 100 ha piece of land

Fees are calculated according to the parcel area, and they must be paid with National Registry legal stamps. It is important to indicate that the previous tables and calculations also include the costs for microfilmed plans.

 

 

            Legal stamps must be placed on the last copy of the plan to be submitted to the National Land Registry, in the space assigned for that purpose. In addition, a ¢20.00 Archive legal stamp must be placed regardless of the area of the plan. This fee amount is charged only once, and does not depend on the number of copies of the plan submitted to be registered.

 

ADDITIONAL COPIES

 

"Article 3° The National Land Registry shall require four copies of the plan submitted for the registration process.

 

One for the archives, one for the Tax Office and two for the interested party.

When more than four copies are submitted, every additional copy shall have, besides the corresponding topography stamps, a fiscal stamp of one colon, and one of the National Registry of two colones".

 

RE-STAMPING SERVICE

 

            "Article 4° The cost of the service for updating the owner's name and registration references of the plan, pursuant to information from the Real Estate Public Registry, shall be 50% of the amount calculated based on the corresponding table".
